Synopsis/ Course Description
An update to the previous versions of Law Society's Condition of sale 1999 and 2012, this course will allow the participants to fully understand the terms and conditions being covered within the Law Society's Condition of Sale 2020 in order to improve their understanding and facilitate their work when utilising contracts and agreements such as Options to purchase and Sale and Purchase Agreements
Learning Outcomes
1. The rules and mechanics of making payment of money to the Conveyancing Account;
2. Inspection of document of title by the Purchaser;
3. The course of action to be taken in the event of dishonoured payment.
4. State and Condition of Property to be delivered by Vendor on delivery of property upon legal completion;
5. How to apportion property tax liability and other outgoing expenses as well as incoming income of the subject property upon Legal Completion.
6. Provisions on payment of Property Tax, Goods and Services Tax and Withholding tax;
7. Provisions on payment of Buyer’s Stamp Duty and Seller’s Stamp Duty;
8. Provisions on computation and payment of Late Completion Interest for the late completion of the deal.
9. Vendor’s Representation and Warranties to the Purchaser that the Vendor has not carried out any unauthorized additions or alterations to the Property and that he has not done any sale at an under-value sale on the property in question;
10. Effect of misdescription of Property on the transaction;
11. Compliance by Vendor on the demands made by Local or Statutory Authorities before Legal Completion;
12. Passing of risk of property to the purchaser;
13. Provisions of delivery of a Conveyance of the Property to the Purchaser on full payment;
14. Provisions on the giving of a Notice to Complete by either party;
15. Resolving disputes through Mediation; and
16. Effect of Special Conditions on the relevant Opti0n To Purchase and Sale and Purchase Agreement.
Certification
A Certificate of Attendance and 2 Professional Competencies CPD credits will be awarded to participants upon completion of the course.
